- Idaho Code 41-2502 requires insurers to include uninsured and underinsured motorist coverage in liability policies. The named insured may reject either or both, in writing or in an electronic record. The Department of Insurance's rulemaking page describes it as coverage insurers must offer, which a consumer can reject when the policy is first purchased.

Penalties
Penalties for driving without insurance in Idaho
Under Idaho Code 49-1232, failing to carry proof of liability insurance is an infraction punishable by a $75 fine for a first violation. A second or later conviction within five years is a misdemeanor punishable by a fine of up to $1,000, up to six months in the county jail, or both. Separately, the Idaho Transportation Department says vehicle owners without insurance for two consecutive months get a warning and 30 days to provide proof or obtain an exemption before the registration is suspended, with a $75 reinstatement fee.
